Take notice that an application for a minor variance has been submitted under Section 45 (1) of the Planning Act, R.S.O. 1990, Chapter p. 13, by Darrell Morgan, on behalf of Margaret Morgan for the property legally described as PLAN M302 LOT E PCL 17599. The subject property is locally known as 73 Fanning Avenue, Municipality of Sioux Lookout. 

The subject property is currently developed with a single-detached dwelling and two private detached garages. The applicant is proposing to construct a detached garage with a size exceeding the maximum size for a detached garage located in the residential zone, on a property with a lot area greater than 4,000 square metres. The proposed detached garage will be located in the required front yard; the Municipal Zoning By-Law does not permit accessory buildings within a required front yard. The proposed detached garage will be an addition onto an existing garage. 

The subject property is located within the Rural Residential (RR) Zone in the Zoning By-law, and is designated Residential in the Official Plan. Key maps showing the subject property and proposed variance are shown on page 3. 

The purpose of the Minor Variance application is to:

  • Seek relief from the maximum size for a detached garage in a Residential Zone, on a property with a lot area greater than 4,000 square metres. 
  • Permit an accessory building in a required front yard.

A variance is required from the following sections of the Zoning By-Law:

  • Section 4.2.3 i) An accessory building or structure is not permitted in any required front yard in a residential zone, where the yard abuts a road. 

    The applicant is proposing a detached garage in a required front yard, where the yard abuts a road. The proposed detached garage will have a reduced front yard setback of 11 metres; 18 metres is the required minimum front yard for the Rural Residential zone.

  • Section 4.2.4) Maximum size of a private garage in a Residential Zone – for lots greater than 4,000 square metres, the maximum permitted size of a private garage shall be 235 square metres. 

    The applicant is proposing a detached garage with a size of approximately 348 square metres. The proposed detached garage will be an addition onto an existing detached garage with a size of approximately 143 square metres, for a total of 491 square metres, on a property with an approximate lot area of 22,270 square metres. 

The Sioux Lookout Committee of Adjustment will hold a Public Hearing on Wednesday, January 28, 2026, at 5:00 p.m. in Council Chambers at the Municipal Office to consider this application.

If you wish to make any written comments, please forward them to the undersigned prior to the hearing date, or you may attend the meeting and give verbal comments at the hearing. If you wish to participate or speak at the Public Hearing, please contact the undersigned before noon on Wednesday, January 28, 2026. If comments are not received by the above date, the Committee of Adjustment will assume there are no comments or concerns. 

A person or public body that files an appeal of a decision of the Committee of Adjustment in respect of the proposed Minor Variance must make a written submission to the Secretary-Treasurer of the Committee of Adjustment, PO Box 158, Sioux Lookout ON P8T 1A4. If you wish to be notified of the decision of the Committee of Adjustment, you must make a written submission to the Planning Coordinator (address below).
